Hey Folks,
you might get me wrong on this, but isn't Vavle just trademarking "DOTA 2" and "DOTA 3"? I think i heard that.
And i don't think that Vavle, even if they would be able to, would claim any of their rights, because Blizzard has a good pressuring medium. They could simple disallow the hosting of WC3-DotA (because, technically, if they own it and Valve owns the rights on the name, they aren't allowed to contribute the map, i guess) which would make the whole DotA-Community stand up against Valve.
The Kespa-Conflict has shown that it's no good idea to mess with Blizz.
How could Valve copyright DOTA if that name was originally used in WarCraft III, a Blizzard game? Wouldn't the name DOTA therefore be the property of Blizzard?
Blizzard was lucky DotA was created, its their fault they didn't take advantage of that. Icefrog has every right to do whatever he wants with it. There has always been a separation between Blizzard and the community. Hopefully this wakes up their eyes.
You don't need to "take advantage" of something to acknowledge that it exists.
This thread is so full of bullshit....anyways I have to post my own bullshit for this thread too:
The tool used to create DOTA belongs to Blizzard
The models/sound/etc... belongs to Blizzard
The "idea" for the heroes, items, gameplay, abilities, functions, names..... belongs not to Blizzard, because you can't claim over intellectual property by writing something into the editor-tool. All that what DOTA made to DOTA, belongs to the founder and developer of the map.
Just because Blizzard realizes that they can make money out of a map based on their game, they don't need to start crying and claiming that Valve wants to take DOTA away from them.
Let's not forget the incompetency that Blizzard has shown in the recent past. I'd rather see Valve put the name to use; a chance for this great genre to move past a company past its prime (HoN and LoL don't count as serious attempts). Besides, IceFrog deserves the most credit for DotA and we all know where he is working...

Hope that blizzard gets a hard buttfuck!
The "idea" for the eroes, items, gameplay, abilities, functions, names.. belongs to blizzard and not icefrog... icefrog just pick a map (named lost temple on starcraft 1) and place an AOS type map in it.. before the frozen throne, dota is not really played and wasn't so popular map.
Where come the idea of heroes on fight of undead/good forcies? By Blizzard. Before warcraft 3 there wasn't any map or game with heroes on RTS.
And the name of many abilities and items come from warcraft 3 items. "Mask of the death"^^
Icefrog just steal an idea map and make it good, and stop.
I really hope valve and icefrog fail miserely.
I can't even believe people are argueing about this. blizzard owns the editor they used therefore owns the project, just like in diablo 2 when people were trying to sell items online, you can't. blizzard owns the art, blizzard owns the editor, and yes the eula states blizzard is primary holder of license of any project, i remember because I used to play/make maps for wc3.
Valve has no claim whatsoever, and blizzard isn't even doing anything evil about it.
valve tried a dota-like game already, it failed big time.
I'm not sure why everyone is having a shot at Blizzard, they aren't even trying to trademark Dota. Valve is the greedy company because they don't want anyone else to use the name even though they have a very shaky claim for trademarking it. It is true that Blizzard doesn't have a solid case for a trademark but like I said earlier, they aren't attempting to trademark the name. Blizzard is happy for the Dota name to be used by everyone, so stop the mindless arguments about who has more claim.
Me: meh you wont notice millions of other people use it why is he gunna focus on me
Him: Yah proberly
Me: * build a massive footbal staduim everyone uses*
Valve: LETS HIRE A WORKER WHO >>HELPED<< MAKE THE STADUIM, and then steal all the ideas fom the real makers the cominity and then call it ours and copy write it.
Him: you can't do that thats just one of the people who worked on it
Me: yah thats a load of bull shit
Valve: well becuase people know him we'll his name to steal the idea from the comuinity and the money from you.
Indeed, it did. Before that post I had no idea who you were. Now I know you're not very intelligent. Let's see why. There should be no "him" in that conversation. Blizzard does not have claim over the ideas. Even you attribute those to the community. However, to marginalize IceFrog's contribution and redirect credit to the community is quite ignorant. The community is out of the picture, nothing can be stolen from them. You fail to realize that the community only contributed ideas on a micro level. Furthermore, the breakdown of who and what is absolutely impossible. The macro level ideas are IceFrog's, and those are the ones that matter anyway. Therefore, no ideas were stolen and no money either.
Nope being dead serious. Even the whole 'Dota storyline' is just a resemblance of the War3 lore, involving the Lich King. It's all Blizzard's stuff come on.
Lets not forget IceFrog never created Dota, he merely picked up the reigns of someone else's project, the vast majority of the Heroes for example were all in there already and invented by the original maker, he never made them up. Although he did do a fantastic job on updating the project as a whole.
Lastly, what I'm saying is, the 'brand' Dota does not belong to IceFrog, far from it. Valve trademarking it I'm against.
Ah, I read into your post more than you intended. I don't know about the lore, as I never paid attention to that really. It is quite possible that in this regard DotA did not change much. However, it's irrelevant nonetheless. You don't play this type of game for the lore, you play it for the gameplay alone. In that regards, DotA changed a lot.
It should be common knowledge that IceFrog didn't create DotA. However, you don't do him justice. Yes, a lot of heroes were given to him. But, not the vast majority...he definitely added a lot of new content. Even you admit that he did a fantastic job updating the game...but this is a rather severe understatement. He transformed DotA from a popular custom map into a worldwide phenomena, and birthed a genre as a result. I'd say an analogy to this would be Counter-Strike.
Regarding the ownership of the brand, you're correct in saying that the history of DotA does not make it clear cut who should have it. I too am against a trademark. But if someone has to get it then it should be Valve (because of IceFrog). However, I fully support Valve calling it DotA because IceFrog does have the right to use the name.
Regardless of your position on this debate, DotA 2 will certainly be a game to keep a close eye on. After all, the best RTS modder ever is working on it. Love him or hate him, it will be awhile before anyone comes close to the level of accomplishment that IceFrog achieved.

i'm merely saying that blizzard gave the tools to make the map, and the comuinity used them. Say you built a shed and you borrowed your friends tools, he cant just say you used my tools the shed is mine now.

So what is the point of "him" then? In other words, what role does Blizzard have in this debate?

Uh, did i miss something? Aren't Blizz and Gretech taking MBCGame and OGN to court? I was pretty sure ;D

Yes exactly, especially how tonnes of the stuff in Dota such as the Heroes are just the standard default War3 lore with barely a minor deviation.
You're being sarcastic right?

The trademark should be given to whoever came up with the name in the first place. Then, he should donate it to the community.
