You should be starting with the head. It is much easier to have correct proportions that way. Many parts are sharp and deformed. There are many more polygons than you need.

If you're making a Game Character, I would follow what Kanaru has said starting with the head.
Also, make your legs somewhat straight as well; it's easier to rig them.
Use alot of reference. ALOT of reference of every single little detail that you do. Even wrinkles if it come to that (Bump Mapping).

I actually showed the version with turbosmooth on it, I noticed someone suggested I'll need it for baking. I also did my research on baking, which is essentially taking the high quality textures I created, and applying to my lowpoly.

Is Blizzard going to come knocking at his door with a warrant demanding to know if he used a licensed version of 3DMax? Are they going to somehow check to see if every author who made a map using custom models has a legit version of modeling software? I don't understand your point I guess.
Blizzard's legal obligation is to pull content suspected of stepping on trademark / copyrights... If they don't know, they won't care. The people who would be most likely to be active about keeping 3DSMax from being used by pirates is the company that owns the rights to 3DSMax in the first place. And when was the last time you ever heard of them going after people for pirating their software? Why wouldn't they?

Who is their customer? Average joe? Nope... Art student? Mabey... Professional Artist, Def.
Why would somebody pay for the product? Because the product they produce, they intend to sell. And they could be sued for making money with a product produced with pirated tools.
So why would the company look the other way about their software being pirated by everybody else? People who have played with the program a long time already (usually by piracy), will be more likely to use the same software when they enter the working world... and thus pay for the program.
Conclusion: At 3500$ a copy, people don't just throw money on this if they think they are going to waste it. There are other 3d modeling software programs out there... The company has to indoctrinate those who are interested in the field, so they will prefer this software to another... and then pay the 3500$ So I doubt that any harm is going to come to him for pirating this program.
looks a bit too high poly and a bit to square, the side of the leg looks good but the other angles dosen't look round or organic. like a said too square
you really think he would tell openly he has no license (phew, good i work in a 3D company and we do have a Max license here)

only problem with your model is that you are modeling a square wireframe, which will lead to animation problems in the end!
u need to model along natural seams, like musclesbulges and so on, not in vertical and horizontal lines!

And he won't. He simply said that it doesn't matter. You don't know he doesn't have one, so you can't say he doesn't have one and get into trouble for using his model in your map.

you do know there is freeware program that can do simuler thing as 3dstudio, cos when you use it to model low poly i wont reqirement 3dstudio.

There used to be a freeware version of 3DSM called gmax. It's been years since it was taken down though. Oh jolly days.

Really though, Maybe move the vertex's in a bit and then pull a row of verticies outwards so the ass is an extruded square, not a sharp prism.
